Welcome to legacyprojectstudio.com (the “Site”), operated by Legacy Project Studio LLC (“we,” “us,” or “our”), located in Brooksville, Florida. By using this Site, submitting our contact form, or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the Site.

1. Who We Are

Legacy Project Studio LLC creates photo memory movies and related keepsake products from photographs, video, audio, and other materials supplied by our customers.

2. Using This Site

You may browse the Site and view sample work for your own personal and informational purposes. You may not copy, download, republish, or redistribute videos, images, or written content from this Site without our written permission.

You agree not to use the Site to transmit harmful code, attempt unauthorized access, or interfere with its operation.

3. Our Content

All sample films, images, written copy, designs, and other materials on this Site are owned by Legacy Project Studio LLC or used with permission, and are protected by copyright. Sample work is displayed to show the quality of our services and does not grant you any license to use it.

4. Contact Form and Inquiries

Submitting an inquiry does not create a contract or obligate either party. A project begins only when we and the customer agree on scope, price, and timeline, and the order is placed.

5. Orders and Payment

Scope of work. The services and products included in your project are those described in the package or quote you accept. Anything not described in that package or quote is outside the scope of the order.

Pricing and payment. Prices are as stated at the time of your order. Payment terms, including any deposit, are stated at checkout or in your quote. We may require full payment before final delivery.

Payment processing. Payments are handled by a third-party payment processor. Your full payment card number is submitted directly to that processor. We do not receive or store full card numbers.

Sales tax. Florida sales tax is applied where required by law.

6. Materials You Provide

Your responsibility. You are responsible for supplying the photographs, video, audio, names, dates, and other information needed for your project, and for the accuracy of that information. We build your project from what you give us.

Your warranty. By submitting materials to us, you confirm that you own them or have permission to use them, and that you have the right to have them included in your project. You confirm that you have the consent of any living person shown in the materials, or the authority of the family where the materials show a person who has died. You agree to indemnify and hold us harmless from any claim arising from materials you supplied.

Our license to use them. You keep ownership of the materials you provide. You grant us a limited license to store, scan, edit, crop, color-correct, and otherwise use those materials solely to produce and deliver your project, and to keep archival copies as described in Section 9.

Physical originals. If you send us physical photographs, slides, film, or other original media, we handle them with care, but we cannot guarantee against loss or damage in shipping or handling. Please send copies rather than irreplaceable originals when possible. Our liability for lost or damaged physical originals is limited to the amount you paid for your order. We recommend insuring valuable shipments. Originals are returned by the method agreed in your order.

Music. We can only include music that is properly licensed for the intended use. If you request a specific commercial song, we may need to substitute a licensed alternative or limit how the finished film may be shared. Copyright restrictions on popular music are set by the rights holders, not by us. Some platforms may mute or block films containing commercial music.

7. Production, Proofs, and Revisions

Timeline. We will deliver within the timeframe stated in your order. The timeline begins when we have received both your payment or deposit and all materials needed for the project, whichever is later. Delays in receiving materials, information, or your feedback extend the delivery date accordingly.

Proofs and approval. We provide a draft for your review before final delivery. Please review names, dates, spellings, and photo order carefully. Once you approve the draft, we produce the final version based on that approval.

Revisions. Your order includes the number of revision rounds stated in your package. Revisions cover corrections and adjustments to the approved scope. Adding photos, changing the length, changing the music, or reworking the concept after production has begun may require additional fees. Corrections needed because of information you supplied incorrectly are treated as new revisions.

8. Delivery, Cancellations, and Refunds

Delivery. Digital films are delivered by download link or physical media as stated in your order. Physical products are shipped to the address you provide, and you are responsible for its accuracy. Risk of loss passes to you on delivery to the carrier.

Cancellation. You may cancel before production begins for a refund, less any deposit covering work already performed and any non-recoverable costs.

Custom work. Our films and keepsake products are made to order and personalized to you. Once production has begun, orders are non-refundable and personalized products cannot be returned. If a product arrives damaged or a film contains an error we made, contact us within 14 days and we will repair, replace, or reproduce it at no charge.

Satisfaction. We want you to be happy with your film, and we will work in good faith to correct anything within the agreed scope. Dissatisfaction with the source material you provided, or a change of mind about content you approved, is not a basis for a refund.

9. Ownership of Finished Work and File Retention

Your finished project. On receipt of full payment, you receive your finished film and products for your personal, non-commercial use, including sharing with family and displaying at memorial or celebration events. Commercial use, resale, or broadcast requires our written permission and may require additional music licensing.

Our retention. We keep project files for a limited period after delivery as a courtesy so that reprints and reorders are possible. We are not obligated to store your files indefinitely. Please keep your own copy of the finished film and of any originals you sent us.

Use of your project as a sample. We will not use your film, photographs, or family’s images in our portfolio, website, or advertising without your permission.

10. No Guarantee of Emotional Outcome

We take great care with memorial and tribute work. We cannot guarantee any particular emotional response from you or your family, and our responsibility is limited to producing the project as described in your order.

11. Third-Party Links

The Site may link to third-party websites or platforms. We are not responsible for their content or practices.

12. Disclaimer of Warranties

The Site and our services are provided “as is,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free.

13. Limitation of Liability

To the fullest extent permitted by law, Legacy Project Studio LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site, our services, or any product we deliver. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Legacy Project Studio LLC from any claims, damages, or expenses arising from the materials you supplied, your use of the finished project, or your breach of these Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Hernando County, Florida.

16. Changes to These Terms

We may update these Terms at any time. The updated version takes effect when posted, and the “Last updated” date will change. Continued use of the Site means you accept the revised Terms.
